Image LICENSING is confusing, I know.
Hopefully I can help simplify it. View the different options to the left with the definitions listed below.
NON-EXCLUSIVE: Photographer may enter into separate license agreements with third parties at any time
LIMITED: Allows the Client to: Use, display, or publish the images captured during the shoot in any commercial, personal, non-profit or editorial projects involving print collateral, website publication, award submissions, and social media for their own marketing needs.
(Exclusions: Editorial cover; any paid print, online or outdoor advertising; and broadcasting. All other uses will be re-negotiated at the current fair market value determined by Getty Images.
UNLIMITED: Allows the Client unlimited print and online usage in any media for worldwide distribution of images for their own marketing needs (Exclusions: broadcast & outdoor advertising).
NONE: No third-party rights granted -- images may not be resold or redistributed by the client to third parties in any form.
*Note: If Client has national dealers/rep groups/resellers who will need to use the images on social media, an additional “Reseller Fee” will be added to the cost of the shoot to account for the additional usage. This fee will be based on the total number of resellers and quoted on an individual basis.
X YEARS: This license shall be valid for X years (with the option to extend after X years -- within 6 months of contract expiration -- at a pre-determined rate).
UNLIMITED: This license shall be valid for an unlimited amount of time.
NOT-TRANSFERRED: Photographer retains copyright ownership in perpetuity and is free to use the images at will.
INDIVIDUAL IMAGE PURCHASE PRICE VS. ADD-ON TO SHOOT PRICE — WHAT’S THE DIFFERENCE??
Clients are always encouraged to participate in a cost-share agreement prior to the shoot in order to save money. However, if that isn’t feasible, 3rd parties can always purchase a license after the shoot is over but it will be more costly. Why?? Well, it simply comes down to instant satisfaction and convenience. Upon payment, you immediately get a link to download the high-res images. On the flip side, the hiring client did all the hard work—they planned everything out with us, scheduled the shoot, prepped the space, came to the shoot, and then waited for them to be edited. They deserve a break…and a big high-five!
